These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and ClearCar Score LLC, operated by Jay Braswell ("we," "us," or "Company"), governing your access to and use of the website located at clearcarscore.com and any services, content, or features offered through it (collectively, the "Service").
By accessing clearcarscore.com, clicking to purchase a report, or otherwise using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately stop using the Service.
ClearCar Score is an AI-powered used vehicle assessment tool. When you provide a vehicle identification number (VIN) and relevant vehicle details, our system analyzes publicly available vehicle data, historical records, and market pricing information to generate a scored report on that vehicle's estimated condition, history, and relative value.
The report is informational in nature. It is not a professional vehicle inspection, a guarantee of vehicle condition, a legal appraisal, or a warranty of any kind. ClearCar Score is one data point to assist in your car-buying decision-making process. It does not replace a physical inspection by a qualified mechanic or certified vehicle inspector.
Our reports are generated using third-party data sources and artificial intelligence models. The accuracy, completeness, and timeliness of underlying data are subject to the limitations of those data sources and are not guaranteed by ClearCar Score LLC
You must be at least 18 years of age to use this Service and purchase a report. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement. If you are under 18, you may not use this Service.
ClearCar Score operates on a per-report, one-time purchase model. There are no subscriptions, recurring charges, or hidden fees. You pay once for each vehicle report you request.
All payments are processed by Stripe, Inc., our third-party payment processor. By completing a purchase, you agree to Stripe's terms of service available at https://stripe.com/legal. ClearCar Score does not receive, store, or process your full payment card number or CVV at any point. Stripe handles all cardholder data in a PCI DSS-compliant environment.
Because our product is a digitally delivered informational report, all sales are final once the report has been generated and delivered to your email address. We do not offer refunds after a report has been sent to you, regardless of whether the report contains information you find unsatisfactory, unexpected, or inconsistent with your expectations.
If you did not receive your report due to a technical error on our end (for example, an email delivery failure or a system outage during generation), contact us at [email protected] and we will work to resolve the issue promptly, including resending the report at no additional charge or issuing a refund at our discretion.
If you believe you were charged in error (for example, a duplicate charge), contact us within 7 days at [email protected] with your order details and we will investigate.
THE CLEARCAR SCORE REPORT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY.

ClearCar Score LLC makes no representation or warranty that the information in any report is complete, accurate, current, or suitable for any particular purpose. Your reliance on any report is entirely at your own risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. EXHAUSTED INC. EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
We do not warrant that the Service will be available at all times, that errors will be corrected, or that the site or its servers are free of viruses or harmful components.

IN ALL CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SPECIFIC REPORT THAT GAVE RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

All content on clearcarscore.com — including the website design, text, graphics, logos, report format, AI scoring methodology, and software — is the proprietary property of ClearCar Score LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service and any purchased report for your personal, non-commercial use only. Nothing in these Terms transfers any intellectual property rights to you.
Our reports are generated using data obtained from publicly available vehicle records, commercial vehicle history databases, and market pricing data. We are not responsible for errors, omissions, or inaccuracies in the underlying data provided by those third parties. The presence or absence of information in a report does not constitute a guarantee or certification of any particular fact about a vehicle.
Your use of the Service is also governed by our Privacy Policy, available at clearcarscore.com/privacy. The Privacy Policy is incorporated into these Terms by reference.
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this document. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service immediately ceases.
These Terms and any dispute arising out of or related to your use of the Service shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict-of-law provisions.
Any legal action arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Georgia, and you hereby consent to the personal jurisdiction of such courts.
Informal Resolution First: Before filing any formal legal action, you agree to contact us at [email protected] and attempt to resolve the dispute informally. Most issues can be resolved through direct communication.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClearCar Score LLC with respect to your use of the Service and supersede all prior or contemporaneous communications, whether written or oral, relating to the subject matter hereof.
